In a significant ruling, the Bombay High Court has dismissed a petition filed by Faaiz Anwar Qureshi, who identifies as a cine worker and artist, seeking a complete ban on Pakistani artists in India. The petition had specifically called for a prohibition on the employment, solicitation of work, or collaboration with Pakistani cine workers, musicians, singers, lyricists, and technicians by Indian citizens and companies.
The division bench, comprising Justices Sunil Shukre and Firdosh Pooniwalla, categorically rejected the plea. In their judgment, the justices emphasized the importance of promoting peace, harmony, and tranquility within the country and across borders. They noted that activities such as arts, music, sports, culture, and dance transcend nationalities, cultures, and nations, playing a crucial role in fostering unity and harmony.
The court also highlighted the example of the ongoing cricket World Cup being held in India, where the cricket team from Pakistan is participating. This, they stated, is a result of positive steps taken by the Government of India in the interest of overall peace and harmony, aligning with Article 51 of the Constitution of India, which emphasizes the promotion of international peace and security.
This decision by the Bombay High Court underscores the importance of cultural exchange and collaboration as a means to bridge divides and promote goodwill between nations. It reaffirms the belief that art and culture have the power to transcend borders and contribute to peace and harmony.
